Terms of Service

These Terms of Service ("Terms") govern access to and use of SalesLobe, the reply management platform available at www.saleslobe.com and app.saleslobe.com (the "Service"). The Service is provided by Den Hartogh Solutions, registered with the Dutch Chamber of Commerce (KVK 93891237) and based in Velp, the Netherlands ("SalesLobe", "we", "us").

1. Acceptance

By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of a company or other organization, you represent that you have the authority to bind that organization, and "you" refers to that organization.

2. Business use only

The Service is offered exclusively to businesses and professionals. By using the Service you represent that you are acting in the course of a trade, business, or profession, and not as a consumer. Provisions of consumer protection law, including any consumer right of withdrawal, do not apply.

3. Account and security

You must provide accurate account information and keep your credentials confidential. You are responsible for all activity under your account. Notify us immediately at info@saleslobe.com if you suspect unauthorized access.

4. Free trial

New workspaces start with a 14-day free trial including 150 Neural Credits and 1 campaign or 1 inbox, no credit card required. Trials are intended for genuine evaluation: we may limit or terminate trials that are abused, for example through repeated trial accounts. If you do not subscribe after your trial ends, we may delete the workspace and its data after a reasonable period.

5. Plans, billing, and payment

Subscription prices, plan limits, and included Neural Credits are listed on our pricing page. Subscriptions are billed monthly in advance through our payment provider, Stripe. Prices are exclusive of VAT where applicable. We may change prices with at least 30 days' notice; changes take effect at your next billing period. If a payment fails and remains unpaid, we may suspend the Service until payment is received.

6. Cancellation and refunds

You can cancel your subscription at any time from your account settings. Your access continues until the end of the current billing period. Fees already paid are non-refundable; we do not offer pro-rata refunds for unused time or unused credits.

7. Neural Credits

Neural Credits are consumed by AI actions in the Service, such as classifying a reply or generating a draft. Unused plan credits do not roll over between billing periods. Credits purchased as top-ups are valid for 12 months from purchase. Credits have no monetary value and are not transferable or redeemable for cash. We may adjust how many credits specific actions consume; if we do, we will give notice before the change applies.

8. Acceptable use

You agree not to use the Service to:

  • send spam or unsolicited bulk email in violation of applicable law, including CAN-SPAM, CASL, the GDPR, and the ePrivacy rules;
  • process prospect data without a lawful basis;
  • send unlawful, infringing, or harassing content;
  • interfere with or circumvent security measures or usage limits;
  • reverse engineer the Service; or
  • resell the Service without our written agreement.

You are responsible for the content of every message sent through your account and for your compliance with the laws that apply to your outreach. We may suspend or terminate accounts that violate this section.

9. AI-generated content

SalesLobe uses artificial intelligence to classify replies and generate draft responses. Drafts are suggestions. You are responsible for reviewing, editing, and approving AI output before it is sent.

Autonomous sending is disabled by default. If you enable it, you do so at your own discretion, under thresholds you configure, and at your own risk. Every message sent through the Service, whether sent manually or autonomously, is treated as sent by you.

AI output can be inaccurate, incomplete, or inappropriate for a given context. We do not guarantee the accuracy or fitness of AI output, nor any particular outcome, response rate, or business result.

10. Your data

You retain all rights to your data: your emails, prospect data, tone guides, and campaign content. You grant us the rights necessary to process this data solely to provide and support the Service. For prospect data we act as a processor under the GDPR; a Data Processing Agreement is available on request. We do not use your data to train shared AI models. You can export your data via the Service or by contacting us. Our Privacy Policy describes our data practices in detail.

11. Third-party services

The Service integrates with third-party tools such as Smartlead, Gmail, Outlook, and Make.com. These require your own accounts and are governed by their own terms and privacy policies. We are not responsible for third-party services, their availability, or changes to their APIs. If a third party changes or discontinues functionality the Service depends on, we may modify or discontinue the affected features.

12. Availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability and offer no service level agreement. We may perform maintenance that temporarily interrupts the Service and will aim to announce planned maintenance in advance. Support is provided by email.

13. Intellectual property

We retain all rights, title, and interest in the Service, including its software, AI configurations, and branding. Your subscription grants you a limited, non-exclusive, non-transferable right to use the Service for the duration of your subscription. If you send us feedback or suggestions, we may use them without obligation to you.

14. Warranty disclaimer

To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or uninterrupted.

15. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect or consequential damages, including lost profits, lost revenue, lost data, or damage to goodwill. Our total aggregate liability arising out of or related to the Service is limited to the amounts you paid us in the 12 months preceding the event giving rise to the claim.

Nothing in these Terms limits liability for damages caused by intent or deliberate recklessness (opzet of bewuste roekeloosheid) or any other liability that cannot be limited under Dutch law.

16. Indemnification

You will indemnify and hold us harmless against third-party claims arising from: the content of messages sent through your account; your processing of prospect data; your violation of anti-spam or data protection laws; or your breach of these Terms.

17. Term and termination

These Terms apply for as long as you use the Service. You can stop using the Service and cancel at any time. We may suspend or terminate your account if you materially breach these Terms; where reasonable we will give notice and an opportunity to cure, but we may act immediately for serious violations such as spam or abuse. After termination you have 30 days to export your data, after which it is deleted in accordance with our Privacy Policy.

18. Governing law and disputes

These Terms are governed by Dutch law. Any dispute arising out of or in connection with these Terms or the Service will be submitted exclusively to the competent court of the Gelderland district (Rechtbank Gelderland), the Netherlands.

19. General

We may update these Terms. For material changes we will notify you by email or in the app at least 14 days before they take effect; continued use after that date constitutes acceptance. If a provision of these Terms is invalid, the remainder stays in force. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and any Data Processing Agreement, form the entire agreement between us regarding the Service.
